Artist Terms

This agreement (the "Artist Terms") governs the relationship between figgy ("we", "us", "our") and the independent creators or artists ("Artist", "you", "your") who list and sell their work through figgy.market. By listing your work on our platform, you agree to the following:

1. Scope of Service


figgy provides a platform for Artists to display and sell their work to customers. figgy acts as an intermediary; the contract for the sale of any item is directly between the Artist and the Customer.

  • Artists retain full control over pricing, listing descriptions, and availability of their works.
  • figgy reserves the right to remove listings that do not comply with platform guidelines or these Terms.

2. Artist Responsibilities


Artists are solely responsible for the accuracy, legality, and quality of the listings they publish on figgy. By listing work on the platform, you confirm that you have full authority to sell the piece.

  • All artwork listed must be your own original work, or work for which you have the legal right to sell.
  • Listing information must be accurate and up to date.
  • Artists must not list work that infringes on any registered Intellectual Property (IP), including trademarks or copyrights. This includes unauthorized depictions of public figures, TV shows, movies, or branded characters. Work that clearly falls under established "fair use" laws is permitted.
  • Any disputes arising from inaccurate listings are the sole responsibility of the artist.

3. Packing and Fulfilment


Artists are responsible for packing and dispatching sold works safely and within the agreed timeframe.

  • Packing: You must ensure that all items are packed securely and professionally to withstand transit. figgy is not liable for items damaged due to inadequate packaging.
  • Dispatch: You must endeavour to dispatch items within the timeframe specified on your profile or as agreed upon with the customer.
  • Tracking: Where possible, a tracking link and reference should be uploaded to the order details within 24 hours of dispatch.

4. Shipping, Insurance and Couriers


Shipping is arranged and managed by the Artist, we strongly encourage the use of insurance, and tracking via courier services for all orders.

  • Artists should use a trusted, reputable courier service (e.g., Royal Mail, FedEx).
  • figgy recommends insuring shipments to the full retail value of the artwork being sent.

5. Shipping Issues and Support Escalation


We understand that shipping and fulfilment issues can occasionally occur. The contract for carriage is between the Artist and the courier, meaning:

  • First Step: Any issues arising from shipping (including delays, loss, or damage) must be escalated with the courier service directly by the Artist.
  • Evidence: You should retain all proof of postage and communication with the courier. figgy strongly recommends that Artists take photographs of their packaged orders, to serve as evidence in the event of shipping issues.
  • Support: You may contact figgy for support or mediation only after you have exhausted the dispute process with your courier. figgy reserves the right to request proof of your communication with the courier.
  • Repeat shipping failures may result in account review, suspension, or termination.

6. Fees and Payments


Commission and Payouts: figgy deducts a commission fee from each sale, with the remaining balance paid out to the Artist according to our internal processing schedules. We reserve the right to reclaim, reverse, or offset these payments against future earnings if an order is not successfully fulfilled.

7. Intellectual Property


Artists retain all intellectual property rights to their works. By listing on figgy, you grant the platform a non-exclusive, limited licence to use your listing and profile content for promotional and operational purposes.

8. Limitation of Liability


figgy is not responsible for the quality, safety, or legality of the items advertised, nor the ability of customers to pay for items. Our total liability to the Artist is limited to the amount of commission earned by figgy on the specific transaction in dispute.

  • Artists use the platform entirely at their own risk and are encouraged to maintain their own insurance.
  • figgy is not responsible for the conduct, actions, or omissions of buyers, couriers, or any third parties involved in a transaction.
  • These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
